Offer Description The research will focus on states of emergency, namely the various ways in which legal systems resort to the application of special rules to address social phenomena that pose (or are perceived as posing) a concrete threat to a given community. These rules either replace or supplement those applicable under normal circumstances. Comparative practice reveals a wide variety of approaches to emergency situations, which differ significantly across legal systems and constitutional traditions. Martial law, état de siège, état d'urgence, the state of necessity,



and constitutional or commissarial dictatorship all fall within the broader category of states of emergency. Likewise, this category includes the emergency or derogation clauses that have been incorporated, since the mid-twentieth century, into the principal international human rights treaties. The aim of the research is to develop theoretical models on the basis of the different experiences examined.
Mandatory requirement for admission to the selection: italian Laurea Magistrale, or Laurea a Ciclo Unico, or an equivalent degree from foreign Universities, obtained no more than 6 years prior to the application deadline (i.e obtained after 13/10/2020).
